Terms of service
TERMS AND CONDITIONS
Last updated: __________
These Terms and Conditions (the “Terms”) govern your access to and use of the website located at Jersey House, together with any related pages, online store, content, features, products, and services (collectively, the “Site”). The Site is operated by Jersey House (“Company,” “we,” “us,” or “our”).
By accessing the Site, creating an account, placing an order, or otherwise using any part of the Site, you agree to these Terms and our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies linked from the Site. If you do not agree, please do not use the Site or place an order.
1. Eligibility and acceptance
You represent that you are legally able to enter into a binding agreement under the laws applicable to you. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.
You may not use the Site or purchase products for an unlawful purpose, to violate any applicable law or regulation, to infringe another person’s rights, or to interfere with the security or operation of the Site.
We may update these Terms from time to time. The revised version will be posted on the Site with a new “Last updated” date. Unless a different effective date is required by law, changes apply when posted. Your continued use of the Site after changes are posted means that you accept the revised Terms.
2. Online store and product information
We make reasonable efforts to describe and display our products accurately. However, colors and other visual characteristics may appear differently depending on your device, screen, browser, lighting, or settings. Product images are illustrative and may not show every detail.
Product availability, sizes, measurements, descriptions, colors, and prices may change without notice. We may discontinue a product or limit the quantity available for purchase, subject to applicable law.
The Site is intended for personal, non-commercial purchases unless we have agreed otherwise in writing. We may refuse or cancel orders that appear to be placed for unauthorized resale, bulk resale, automated purchasing, or other activity that violates these Terms.
3. Orders and acceptance
Submitting an order is an offer to purchase the selected products. An order is not accepted until we send an order-confirmation message or otherwise confirm acceptance. An automated acknowledgment that we received your order does not necessarily mean that the order has been accepted.
We may decline, limit, or cancel an order at our discretion when permitted by law, including because of suspected fraud, an apparent pricing or description error, inventory limitations, payment problems, shipping restrictions, or a violation of these Terms. If we cancel an order after payment has been collected, we will issue a refund for the cancelled portion using the original payment method, unless applicable law requires another method.
If we need to change or cancel an order, we may contact you using the information supplied at checkout. You are responsible for ensuring that your billing, shipping, telephone, and email information is accurate and current.
4. Prices, taxes, and payment
Prices are displayed in U.S. dollars (USD) unless otherwise stated. Applicable sales tax, use tax, shipping charges, duties, or other government charges may be added at checkout where required or permitted by law.
You authorize us or our payment processor to charge the payment method you provide for the total shown at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.
Payment details are processed by third-party payment providers. We do not intentionally retain complete payment-card numbers on our own systems. Your use of a third-party payment service may also be subject to that provider’s terms and privacy practices.
If a product or price is listed incorrectly, we may correct the error and, where permitted by law, cancel or adjust the affected order. If payment has already been collected for a cancelled order, we will provide the refund described above.
5. Shipping and delivery
Shipping options, estimated processing times, delivery estimates, fees, and geographic restrictions will be shown on the Site or at checkout when available. Delivery estimates are estimates, not guarantees, unless we expressly state otherwise in writing.
We will use commercially reasonable efforts to ship orders within the time stated at checkout or in the applicable offer. If no shipping time is stated, we will process the order within the period required by applicable law. If we cannot ship within the promised period, we will provide any notice, cancellation option, and refund required by applicable law.
Risk of loss and title pass as determined by applicable law. You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed delivery caused by an incorrect address, refusal to accept delivery, events outside our reasonable control, or the carrier’s handling, except to the extent otherwise required by law.
International orders, if offered, may be subject to customs duties, import taxes, brokerage charges, and other fees imposed by the destination country. Unless expressly stated otherwise, those charges are the customer’s responsibility.
6. Returns, exchanges, and refunds
Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Please review that policy before placing an order. It should state, among other things, the applicable return period, condition requirements, exclusions, return-shipping responsibility, refund method, and treatment of sale or customized items.
Nothing in these Terms limits any non-waivable right or remedy available to you under applicable law.
7. Accounts and account security
Some Site features may require an account. You are responsible for providing truthful information and for keeping your login credentials confidential. You are responsible for activity conducted through your account unless the activity resulted from our failure to use reasonable security measures.
Notify us promptly at __________ if you believe that your account or credentials have been used without authorization. We may suspend or close an account if we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.
8. Acceptable use
You may not use the Site to:
- violate any federal, state, local, or foreign law or regulation;
- infringe, misappropriate, or violate intellectual-property, privacy, publicity, or other rights;
- impersonate another person or provide false, misleading, or fraudulent information;
- interfere with the Site, payment systems, servers, networks, or security controls;
- upload or transmit malware, viruses, harmful code, or disruptive material;
- access or collect information through scraping, crawling, harvesting, phishing, or automated means without our written permission;
- reverse engineer, copy, reproduce, resell, or exploit the Site or its content except as expressly permitted by law or by us in writing;
- submit content that is unlawful, threatening, abusive, defamatory, obscene, discriminatory, or invasive of another person’s privacy; or
- attempt to bypass an access restriction, rate limit, authentication measure, or other security feature.
We may investigate suspected violations and may suspend or terminate access where appropriate, subject to applicable law.
9. User content and feedback
If you submit a review, photograph, comment, testimonial, suggestion, or other material to us or through the Site (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, adapt, publish, translate, distribute, display, and use that User Content for operating, improving, marketing, and promoting the Site and our products.
You represent that you own or control the necessary rights in your User Content and that its submission and use as described here will not violate law or another person’s rights. You must not submit confidential information, payment information, or personal information belonging to someone else without authorization.
We may, but are not required to, review, moderate, remove, or refuse User Content. We do not endorse User Content submitted by users, and you remain responsible for it.
10. Intellectual property
The Site and its contents—including text, product descriptions, photographs, graphics, logos, designs, videos, software, layout, and compilations—are owned by or licensed to Jersey House and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No rights are granted except those expressly stated in these Terms. You may not use our trademarks, branding, photographs, or other content in a way that suggests sponsorship or affiliation without our prior written permission.
11. Third-party services and links
The Site may use or link to third-party services, including payment processors, hosting providers, analytics services, social-media features, shipping carriers, and other tools. Third-party services are governed by their own terms and policies. We do not control and are not responsible for third-party services, websites, content, products, or practices, except as required by law.
12. Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy, available on the Jersey House website. The Privacy Policy is part of these Terms by reference.
If the Site is directed to children under 13, or if we have actual knowledge that we collect personal information from a child under 13, additional requirements may apply under the Children’s Online Privacy Protection Act and related regulations. The Site is not intended to request personal information from children under 13 without the legally required parental process.
13. Disclaimers
To the fullest extent permitted by applicable law, the Site is provided on an “AS IS” and “AS AVAILABLE” basis. We do not promise that the Site will always be available, uninterrupted, secure, accurate, complete, current, or free of errors or harmful code.
To the fullest extent permitted by applicable law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and durability. We do not disclaim warranties or rights that cannot lawfully be disclaimed.
Product warranties, if any, are limited to the express warranty specifically provided with the product or required by law. Statements on the Site are not a guarantee of a particular result, fit, performance, or lifespan.
14. Limitation of liability
To the fullest extent permitted by applicable law, Jersey House and its owners, officers, directors, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, business, savings, data, or goodwill, arising out of or related to the Site, an order, a product, or these Terms, regardless of the legal theory asserted.
To the fullest extent permitted by applicable law, our total liability for claims arising out of or related to the Site, an order, a product, or these Terms will not exceed the greater of (a) the amount you paid to us for the product or service giving rise to the claim during the __________ months before the event giving rise to the claim, or (b) __________.
These limitations do not apply to liability that cannot be limited under applicable law, including certain liability for fraud, willful misconduct, gross negligence, personal injury, or violations of consumer-protection rights.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Jersey House and its owners, officers, directors, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your User Content, misuse of the Site, violation of these Terms, violation of law, or violation of another person’s rights.
We reserve the right to assume exclusive control of the defense of a matter subject to indemnification. You agree to cooperate reasonably with that defense. You may not settle a claim in a way that imposes liability or an admission on us without our prior written consent.
16. Suspension and termination
These Terms remain effective while you use the Site or have an outstanding order or obligation under them. We may suspend or terminate access to the Site, cancel an account, or refuse service when we reasonably believe that you violated these Terms, engaged in fraud or abuse, created legal or security risk, or where otherwise permitted by law.
You may stop using the Site at any time. Provisions that by their nature should survive termination—including provisions concerning intellectual property, User Content, disclaimers, liability limits, indemnification, dispute-related terms, and governing law—will survive termination.
17. Governing law and venue
These Terms are governed by the laws of the State of __________, without regard to conflict-of-law rules, except to the extent federal law or non-waivable consumer-protection law applies.
Subject to any mandatory legal right to bring a claim elsewhere, the courts located in __________ County, __________, will have exclusive jurisdiction over disputes arising from or relating to these Terms, the Site, or an order. You and we consent to personal jurisdiction and venue in those courts.
18. Severability and waiver
If a court finds any provision of these Terms unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
19. Entire agreement and assignment
These Terms, together with the policies and documents incorporated by reference, constitute the entire agreement between you and us concerning the Site and supersede prior or contemporaneous understandings on that subject. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, subject to applicable law.
20. Electronic communications
When you use the Site, place an order, or contact us electronically, you consent to receive electronic communications from us. Electronic communications may include order confirmations, receipts, notices, disclosures, and other messages. You agree that electronic records satisfy legal requirements that communications be in writing, where permitted by law.
